Negotiating vacant possession of an inherited property

How practical tenant negotiations can help executors plan a lawful voluntary handover of a tenanted estate property.

Hermens Property · London and Surrey

Practical, considered property support

Our role is to help executors make informed decisions about the property, its condition and the work needed before a sale or handover. Every instruction is tailored to the property, with contractor costs and any Hermens coordination fee explained before work is authorised.

01

A landlord's death does not automatically end a tenancy

A property passing into an estate may remain occupied under an existing tenancy. Executors should obtain advice on the estate's authority, tenancy terms, statutory rights and proposed steps before seeking possession.

02

Explore a genuine voluntary agreement

With written instructions and clear authority, an agent can communicate openly with the tenant, listen to circumstances, discuss possible moving dates and commercial proposals in principle, and report any tentative agreement back to the executor and appointed solicitor. The tenant must be free to decline.

03

Lawful surrender needs proper advice and documentation

Commercial discussions do not themselves establish that a tenancy has lawfully ended. Appropriate legal advice and, where required, a written surrender agreement should be arranged by the estate's solicitor. No change of locks, harassment, pressure or self-help eviction is acceptable.

04

Complete a documented check-out

Once lawful possession is established, a check-out can record condition against the agreed inventory, meter readings, keys handed back, photographs and any access restrictions. Repairs and cleaning quotations can then be obtained with approval.

05

Deposit discussions supported by evidence

Where deposit deductions are proposed, evidence may include check-in and check-out reports, dated photographs, estimates and invoices. Hermens can discuss an agreed sum within an authorised agency instruction, but the tenant's protected-deposit scheme and adjudication rights remain intact.

06

Separate workstreams, separate fees

An estate may instruct voluntary tenancy discussions, check-out attendance, deposit negotiation, vacant-property visits, clearance or sale individually. Each scope and charge should be agreed in writing without making the sale appointment compulsory.

Tell us the address, who is authorised to instruct work and what needs attention. We can discuss the relevant services and agree a sensible sequence, whether you need one quotation or coordinated preparation for a sale.

Hermens provides property-related services, not probate legal advice, reserved probate work or legal estate administration. Where a formal tax valuation, regulated advice or specialist work is needed, an appropriately qualified independent professional should be appointed.
